The registration of trade mark is valid for a period of ten years (10 years) from the date of registration which may be renewed from time to time in accordance with the provisions of Trade Marks Act & Rule.
Registered proprietor of the trademark is served with a notice intimating the approaching expiration of registration of trade mark and the condition as to the renewal of trade mark electronically as well through registered post within 1-3 months before the expiration of last renewal of trade mark/registration.
The application for renewal may be made by proprietor of the registered trade mark or authorized agent with duly executed Power of Attorney along with prescribed fee for renewal of registration of trade mark.
Application for renewal of registration of trade mark shall be made in prescribed form at the appropriate office or Head Office of the Trade Marks Registry within six months before the expiration of last registration of the trade mark.
The application for renewal may be filed within 6 Month after the expiration of last registration
Subject to payment of a surcharge of sufficient amount and form as prescribed in the Act or else the mark becomes liable to be removed from register.
Application for restoration of the same may be made accompanied by a renewal application with prescribed fee and surcharge after six months but within one year from the expiration of last registration. Upon such Application Registrar has the power to restore the trademark
